Equifax Terms & Conditions of Use


These Terms and Conditions of Use apply to the individual ("you", "your") who instructs Equifax Limited to provide their credit information ("Credit Information Services") to DealTrak via the Can Can Car Finance website at www.cancancarfinance.co.uk (the "Website"). You should also read our Privacy Policy - http://www.equifax.co.uk/About-us/Privacy_policy.html which explains what we may do with your personal information.

Who we are

We are Equifax Limited, ("we" / "us" / "our") a company registered in England and Wales under registered number 2425920 and our registered office is at Capital House, 25 Chapel Street, London NW1 5DS. You may contact us by:

(ii) by telephone on number 0844 335 0550; or
(iii) by any of the other methods described in the "Contact Us" section of our website www.equifax.co.uk.

Ownership

We or our licensors own all the rights to all the materials contained in this website and all the information that our website collects (we refer to all of this as "materials"). Materials also include all patents, copyrights, trade marks and database rights.

Your personal information

We will not provide your credit information directly to you as part of the Credit Information Services. However DealTrak will use your credit information on behalf of Can Can Car Finance for the purposes of identifying and ranking the most appropriate credit products for you, taking into account your personal circumstances ("DealTrak Services").

You may only request your own credit information. You may NOT request credit information on behalf of anyone else, even with their consent. You are advised that it may be a criminal offence under Section 55 of the General Data Protection Regulation to do so in certain circumstances.

Our liability to you

Any information that we publish about you as part of the Credit Information Services is collected by us from third parties and is published by us as soon as reasonably practicable after becomes available. As the materials we publish about you are provided by a number of sources, we cannot guarantee that they are accurate, complete, up-to-date or error-free. As such, we will not be liable to you for any losses you may incur for any information that we provide about you which is inaccurate, incomplete or not up-to-date. Nothing in these terms affects our liability to you for death or personal injury caused by our negligence, or for any other liability we may owe to you, which we cannot exclude or limit by any applicable law. Our total liability to you (whether for breach of contract, in negligence or any other tort, under statute or otherwise) for any loss or damage arising out of your use of the Credit Report Services will be limited to £50.

We shall use our reasonable endeavours to provide the Credit Information Services. We exclude any warranty, condition or representation regarding the availability of the Credit Information Services or the DealTrak Services. We exclude any warranty that the Credit Information Services or DealTrak Services are uninterrupted or error free, or that any of the computer systems used to provide those services are free from viruses or bugs.

We will not be liable to you for any loss of content or material uploaded or transmitted through the Website and we accept no liability for losses incurred by you due to any third party relying on the content of the Credit Information Services or for any action taken (or refrained from being taken) as a result of the provision of the Credit Information Services.

General

These terms (together with the Consent Terms and other relevant information in relation to the Credit Information Services found on the Website) make up the whole agreement between you and us in relation to you requesting the Credit Information Services. If any court having the appropriate authority finds that any of these terms are not valid, this will not affect the validity of any of the other terms set out in these terms of use. If either you or we choose not to benefit from any of these terms, it does not mean that you or we have given up that right.

These terms are governed by and interpreted in accordance with English law. You agree that the English courts will have full authority to settle any disputes that may arise out of or in connection with these terms.

Any person who is not a party to these terms has no right under the Contracts (Rights of Third Parties) Act 1999 to enforce these terms.
